Ukrainian citizenship can be acquired only if there are clearly stated grounds and conditions for this. The procedure for acquiring citizenship is quite complicated and time-consuming, as the decision on citizenship is made by the President of Ukraine. After obtaining Ukrainian citizenship, a foreigner undertakes to renounce the citizenship of his country of origin within two years.

How to become a citizen of Ukraine?

Obtaining Ukrainian citizenship is a very complex process, clearly regulated by state legislation. The decision to give / not give a positive answer is made only by the President. After obtaining citizenship, a foreigner must complete all the necessary documents and go through a difficult procedure to finally become a Ukrainian.

Many mistakes can be made when applying to the competent authorities. Therefore, we recommend that you talk to our consultants from the beginning. This will save you time, money and nerves. MigrationGroup is your most qualified legal aid.

Acquisition of Ukrainian citizenship: grounds and conditions

In order to become a citizen of Ukraine, you must follow some rules. About:

obedience to the law;

lack of citizenship of another country;

5 years of residence in Ukraine without departure;

obtaining an immigration permit;

knowledge of language.

Also, a person must fully provide for themselves financially (ie, have a legal job).

But there are some exceptions, as some people can obtain citizenship under the simplified system. It’s about the country’s natives, Ukrainian children and those born here. The list also includes people with citizenship who have lost their citizenship and incapacitated persons with local guardians.

Documents for citizenship

Collecting the necessary documents is the first step towards acquiring Ukrainian citizenship. You need to present:

Passport.

Certificate of permanent residence.

Receipt of payment of taxes.

3 photos in 3.5×4.5 format.

The list also includes documents stating that:

a person has lived in Ukraine for 5 (with the citizenship of another country) or 3 (without citizenship) years;

no citizenship. It can also be a statement of commitment to waive it;

the person has an immigration permit and a permanent residence permit;

you speak the state language;

you have special rights to become a citizen;

the person has a job;

you are a person with a disability (if required).

Documents must be translated into the state language. An application is also attached to the full package.

This is a very responsible step. After all, the slightest mistake in the design can lead to failure. All data must be carefully checked several times.

Then the documentation is submitted to the nearest department of the State Migration Service of Ukraine. The maximum term of consideration is one year. But usually the representatives of the department cope in a few months.

If everything is done and collected correctly and there are no grounds for refusal, the applicant is issued a certificate stating that he is now considered a citizen of Ukraine. You will need to make a passport based on this document.

Acquisition of citizenship in Ukraine: reasons for refusal

Public authorities have the right to deny citizenship to certain persons. These categories are clearly defined by law. The case of persons who have been convicted:

for committing crimes against humanity;

in Ukraine for any crime.

You may also not prove your citizenship. But the most common refusal occurs after an incorrectly written application and incorrectly collected package of documents.

Procedure for obtaining Ukrainian citizenship by birth

This right is enshrined in the Law on Citizenship. A person can obtain citizenship according to the following criteria if:

one or two parents had citizenship;

the person was born in the country, and the parents lived here legally;

the person was born in another country, but the parents lived in its territory;

the person was born in our territory, the parents (citizens of another country) lived in Ukraine, but the child did

not become a citizen as one of the parents.

An exhaustive list of items on which a person can become a citizen of our country by birth can be found in the Law.

Obtaining Ukrainian citizenship by a child is carried out in the nearest unit of the State Migration Service. You need to present:

copy of passport;

the original document on the place of registration;

Birth Certificate;

a copy of a document confirming the citizenship of one of the parents or significant circumstances that allowed

the parents to be in the country with legal rights at the time of birth;

declaration of non-citizenship of another state;

if necessary – a refugee certificate.

You also need to write a standard statement.

Peculiarities of acquiring citizenship as a result of recognition of paternity or maternity

There is a situation when one of the parents has the citizenship of Ukraine, and the other is a person without this status. In this case, the child can become a local citizen only by father or mother. And such acquisition of citizenship of Ukraine is carried out only through the court. You need to collect documents:

copies and original of the passport;

documents proving residence in a certain country;

copies of documents of the other parent without citizenship of Ukraine;

the court decision on the basis of which the establishment of paternity or maternity was made;

child’s birth certificate;

two photos measuring 3.5×4.5.

Children between the ages of 14 and 18 must write a statement agreeing to obtain Ukrainian citizenship. A notarized translation into the state language is also attached to the entire package.

How to obtain citizenship in a simplified manner?

If a person lived in the country before Ukraine gained independence, he has the right to obtain citizenship under a simplified procedure. This category also includes people whose at least one relative had citizenship until mid-1991.

You will need to collect a specific package of documents:

passport;

birth certificate issued in the country (yours or a relative);

documentation of family ties;

certificate of non-citizenship of another country.

Each document must be translated into Ukrainian and notarized.

* Documents indicating family ties are evidence of:

birth;

marriage;

change of surname.

If any documents have been lost, the procedure is complicated.

The simplified procedure also includes obtaining Ukrainian citizenship through marriage. But in this case, you will have a slightly different procedure for submitting documents.

How to renew citizenship?

Some people may lose their citizenship for some reason. It can be renewed by a simplified procedure. But situations are different. Therefore, only qualified lawyers from our company will tell you how to act in a particular case. We advise you to contact them as soon as possible.

Can they refuse to obtain Ukrainian citizenship by territorial origin?

Of course they can. The law specifies a list of such circumstances. Example:

Incorrect documentation.

You do not have the right to citizenship.

You have been convicted of a crime against humanity.

You have an outstanding or unresolved criminal record for serious or especially serious crimes in Ukraine o rabroad.

Some people may have lost their citizenship at one time because they obtained it by deception. From all this list, only people who have submitted documents incorrectly can become a citizen of Ukraine.

How to get a certificate of citizenship of the child?

Such documentation is an integral part of proof of citizenship. The fact is that the birth certificate will not provide such information. It indicates only the fact of birth.

Usually, such a certificate is issued in cases where:

one of the parents is Ukrainian and the other is a foreigner or a stateless person;

mother and father are foreigners.

The procedure for obtaining help includes collecting copies:

birth certificates;

passport of a citizen of Ukraine, if any;

parents’ foreign passports;

certificates of foreign citizenship.

You will also need to take two photos of a child over 5 years old. Their size is 3

Citizens of other countries can enter Ukraine if they have a visa or 90/180 entry regime. This gives the right to legally stay temporarily in the country on passport documents. But if you need to stay in Ukraine longer and for some reason you could not issue a temporary residence permit or are waiting for an immigration permit, citizenship, then the legislator has provided for such a procedure as extension of stay in Ukraine.

Below, we will consider three options when you will be able to submit the necessary documents.

First: if you have entered on a transit visa and are forced to stay in the country due to emergencies, then you will be allowed to stay in Ukraine for the amount of time required to eliminate such circumstances and only with supporting documents.

Second: you entered on a long-term visa (a visa type “D”) to apply for a temporary or permanent residence permit, but for some reason beyond your control, you could not apply to the migration service . In this case, you can extend the period of stay of foreigners in Ukraine, for a sufficient period for registration of these documents – a maximum of one month.

Third: whether you are on a short-stay visa or a citizen of a visa-free country, this is the most common case that our company’s clients apply for. Here is a list of grounds defined by law:

Visa-free entry into Ukraine for countries: Azerbaijan, Armenia, Belarus, Georgia, Moldova, Russian Federation, Uzbekistan

Treatment (care for a sick family member). To do this, you must provide a medical certificate, which will indicate the need for inpatient treatment for a certain period. All certificates are checked, so we do not advise you to buy fakes online. This threatens a fine and a ban on entering Ukraine for a period of three years;

Pregnancy and childbirth. Accordingly, a certificate from a medical institution is also required.

Registration of inheritance. In this case, the confirmation will be the presence of an application for acceptance of the inheritance;

Applying for immigration or Ukrainian citizenship. Here the confirmation is issued by the migration service itself, after submitting the documents for the relevant services, you will receive a certified statement by the employee to submit a package of documents for consideration.

We have listed the most common cases for applying for this service, but there are others. Moreover, the list specified in the legislation is not exhaustive.

The process of registration of the extension of the stay takes 3-5 working days and for this period your passport document will be taken away from you, as there will be a mark of extension indicating the date until which you are allowed to stay in Ukraine. After registration, you should not go to other countries, as the continuation stamp is canceled and you will not be allowed back.

I want to pay attention to some more nuances. When submitting documents you will be required to provide:

confirmation of residence in Ukraine (for this you need to find housing, the owner of which will agree to write a statement that he is not against your residence there. And he will be asked to provide his passport and title deeds);

the presence of a host party (a natural or legal person who will bear all the costs associated with your stay in the country).

In case of violation of the established procedure for staying on the territory of Ukraine, the foreigner and the host party will incur appropriate administrative fines.

Also, one of the important conditions is to apply no earlier than ten and no later than three working days before the end of the stay (visa).

Despite this, it is easy to collect documents and submit them to the migration service to extend your stay in Ukraine, but do not forget that mistakes, lack of documentary evidence of good reasons and incorrect calculation of deadlines can lead to denial of registration.

MARRIAGE WITH A FOREIGNER first appeared on Migration Group.

Marriage to a foreigner

The procedure for marrying a foreigner is more complicated than marrying a Ukrainian, as it requires additional approvals from the migration service. We help with the preparation and translation of documents for approvals. Accompaniment of a lawyer when visiting government agencies, when applying for marriage. We provide apostille and legalization of marriage certificate for foreign countries.

Marriage to a foreigner on the territory of Ukraine

Today, Ukrainians often want to start families and marry foreigners. If you want to get married in Ukraine, it will not be as difficult as in most countries. However, this procedure also has its nuances. If you want to save time and effort, consult a professional lawyer. MigrationGroup offers you its services. We will help you get married quickly and easily.

If you want to marry a citizen of another country, you may have problems. Due to differences in the laws of different states, the registration of such a marriage is quite a difficult task.

The nuances of registering a marriage with a foreigner

The main thing is that a foreigner must be legally in Ukraine at the time of registration. Therefore, the application must be submitted one month before the end of the permitted period of stay. Otherwise, the permit may expire and the marriage will become impossible.

Another important detail is the translation of documents into Ukrainian. There may be some difficulties with this, as the translations must match. In addition, it often happens that translations of certificates are done improperly, and because of this the whole procedure must be done first. After registration, a foreigner will have the right to issue a temporary residence permit in Ukraine. He will receive the right to a permanent certificate after two years of marriage.

In order to get married, you will need to collect the following documents:

Passports of both brides (a citizen of Ukraine must bring a domestic passport, and a foreigner – the passport on which he crossed the border);

Two translations of a foreign passport (one with the seal of the translator, the other – notarized).

If one of the brides or both was previously married, you must also bring documents confirming his termination (certificate or court decision on divorce, death certificate). If these documents are issued in another state, they must be translated and apostilized or legalized.

MigrationGroup provides comprehensive legal support in marriage registration in Kyiv. You can even apply from abroad, we will remotely check all the documents and provide advice on which documents you need to bring with you.

If you want to quickly legalize your relationship with a foreigner and not waste time, you should seek the help of professional lawyers. MigrationGroup offers you its services. We have real professionals with many years of experience, so we will help you get married as soon as possible.

Once your marriage is registered, the foreigner will need to apply for a temporary certificate. To obtain it, a foreigner must obtain a new visa, based on a marriage certificate. The purpose of the visit should be to reunite with the family. This is necessary even when he is a citizen of a country with visa-free entry into Ukraine. Citizens of some countries are exempt from this, but the purpose of the visit should still be the same. In addition, the couple should have the same residence permit. In two years, a foreigner will be able to apply for a permanent residence permit or obtain Ukrainian citizenship.

If a foreigner marries not with a citizen of Ukraine but with another foreigner who has received a permanent residence permit, he can also issue it without waiting for two years. But the right to citizenship, in this case, can be obtained only after five years.

Frequently asked questions when marrying a foreigner abroad:

– Does a marriage with a foreigner abroad operate in Ukraine and entitle the foreigner to a temporary (permanent) residence permit?
Yes, it does not matter where the marriage with a foreigner will be. The marriage certificate with a foreigner will be valid in Ukraine and give him the right to a temporary, and for 2 years to a permanent certificate.

– Is it necessary to re-register a marriage in Ukraine after receiving a marriage certificate with a foreigner abroad?
No, such a marriage does not need to be registered in Ukraine. A marriage certificate with a foreigner is recognized in Ukraine only if it is from other countries, it requires translation, as well as additional certification (apostille or legalization, depending on the foreigner’s country).

As you can see, marrying a foreigner is not an easy process. Therefore, we advise you to entrust this matter to professionals from JSC “MigrationGroup”. We are the best family lawyers and will be happy to help you marry a foreigner. Call +380964447720

Registration in Ukraine 2021: information for foreigners and citizens

According to our laws, registration in Ukraine is necessary not only for citizens, but also for foreigners. This is a very important moment, which no one who has decided to stay permanently in our country can do without.

By the way, we are talking not only about changing the state, but also about moving to a new city. After all, you can get most of the administrative services only at the official place of registration, not stay.

In order to get a residence permit in Ukraine quickly and guaranteed, contact our company. Professional lawyers will assist in this and other issues related to obtaining registration of residence, certificate of permanent or temporary residence, work permit.

How to issue a residence permit to a Ukrainian?

You must first contact the registration authority in your area. This can be an administrative office or a separate registrar. Here you need to write a statement according to the established sample. You must also present a complete package of documents.

Documents for obtaining a residence permit for a Ukrainian

In the administrative body you must present:

Passport. If you do not have it, a temporary or permanent residence permit is suitable. Children under the age of 16 must have the original birth certificate with them.

Check for payment of administrative fee.

Lease agreement for an apartment or house or documents for real estate ownership. Pay attention! Registration at a dacha in Ukraine is possible only where there is a quarter committee and an assigned address. The type of real estate should not be indicated “for horticulture”, but “for construction”.

Conscripts – a military ticket or certificate.

On the one hand, nothing would seem difficult, right? In fact, you may have a lot of problems when submitting documents at the stage of writing an application. You may also be denied if you are subject to conscription or have debts to the enforcement service. For those who are participants in the trial on either side (witness, accused, plaintiff), it is better not to change the place of residence until the meeting is over. People who fall into these categories will simply not be discharged from the old address by the state registrar without a new ZEO certificate.

Pay attention! Registration of children in Ukraine is carried out according to special rules. Those who have not reached the age of 14 are registered at the place of residence of the parents or one of them with the written consent of the other. And registration of a newborn in Ukraine is possible at the stage of registration of a birth certificate.

Do foreigners need a residence permit in Ukraine?

Definitely needed. For foreign citizens, the procedure for registering at a new place of residence in Ukraine is a bit more complicated than for “indigenous” residents. The fact is that you first need to issue a residence permit. By the way, MigrationGroup specialists can also help with this.

Foreigners need to present the same package of documents to the state registrar. Only data on the residence of a foreigner in Ukraine will be entered in the certificate, not in the passport. Registration is carried out in own or rented housing. You must have with you either a contract of sale or a written agreement with the owner, notarized.

The most common questions that foreigners face when applying for a residence permit

Most foreigners after moving to Ukraine try to mark the place of registration in the passport. In fact, our laws forbid it. To obtain a residence permit you need to issue a temporary or permanent residence permit.

Also, some foreigners are interested in whether it is possible to obtain a driver’s license without a residence permit. Again, the answer is no. It is impossible to obtain a driver’s license without registration of residence. And registration becomes possible only after registration of the residence permit.

And a foreigner cannot become an entrepreneur without registration either.

It is quite difficult to issue a residence permit in Ukraine. Especially when it comes to foreigners, they hardly know our laws and have never encountered a legal system of this type. Don’t do it yourself. Trust MigrationGroup.

The post Registration in Ukraine 2021 – how to get a residence registration first appeared on Migration Group.

To work officially in our country, foreigners must obtain a work permit from an employer in Ukraine. In order for all documents to be executed correctly, it is necessary to collect them, translate them into the state language and certify them with a notary. Employment of foreigners in Ukraine takes place after submitting the package and making a copy of the permit for type “D” visa.

Sounds simple and straightforward, doesn’t it? In fact, it is very difficult to do everything right the first time. Why, let’s understand further, and also we will consider the order of employment of foreigners and stateless persons in Ukraine.

Who is issued an employment permit?

To begin with, let’s repeat – foreign citizens can work in Ukraine only with a special permit. An employer who hires an employee without proper registration pays a hefty fine. Therefore, the procedure for employment of foreign citizens in Ukraine should be studied by everyone who plans to live and work here.

As with any rule, there are exceptions to this question. You can not take permission:

Citizens of other countries with lighting for permanent residence.

Foreigners with refugee status or immigration permits.

Non-residents who came to Ukraine in search of protection.

Air carriers and maritime transport workers who cooperate with Ukrainian companies under contract.

Foreign journalists accredited in Ukraine.

Professional cultural figures, athletes who came to Ukraine to work in their specialty.

Emergency or rescue workers who provide emergency assistance in any area.

Persons officially registered in foreign companies, provided that they work at branches or representative offices of these companies.

Representatives of various religious organizations, whose activities are coordinated at the state level.

Citizens who are engaged in teaching or research activities, provided that they have received an invitation from Ukrainian higher education institutions.

Also, non-residents whose activities are carried out under international agreements ratified by the Verkhovna Rada are not required for official employment. In other cases, special documentation is required.

Documents for obtaining a work permit

The procedure for employment of foreigners includes the collection of a complete package of documents. You need to have:

statement;

translation of a passport certified by a notary or made by a court translator;

a copy of a diploma or other educational document;

two photos with a format of 3.5 by 4.5;

a certificate from future work stating that the person will not have access to a state secret;

a copy of the contract or employment contract.

Each document must be certified by the seal of the employer or a notary.

Features of employment of foreigners in Ukraine

After submitting the above-mentioned documentation, the employment center decides to issue a permit or refuse it. Employees have only 7 working days.

When the decision is positive, the employer must pay the state fee within 10 days of receiving it. If this is not done, the permission is revoked automatically. At the same time it is necessary to sign an employment contract or agreement between the foreigner and the company and submit a copy to the employment service. Permission is revoked if this is not done.

The employer keeps the original document, and the employee receives only a notarized copy. It is a foreigner who submits it to the Ukrainian embassy to obtain a “D” type visa. Thus, he issues a temporary residence permit in Ukraine.

How to get a work permit for foreigners in Ukraine?

In fact, such a permit is quite difficult to obtain. You will have to spend a lot of time and get some advice. And even this does not mean that you will collect all the documents correctly and draw them up correctly. The procedure for employment of foreigners and stateless persons is a rather complicated matter.

Thus, a foreigner after obtaining a temporary certificate must register a place of residence (residence permit).

– Should a foreigner permanently reside in Ukraine when obtaining a temporary permit?
No, a foreigner who has received a temporary residence permit can stay in Ukraine for as long as he needs.
